Informed Consent for Telehealth Services

This document provides important information about the telehealth services offered by SwiftCareMD. Please read it carefully. By submitting a consultation request through our platform, you acknowledge that you have read, understood, and agree to the terms described in this Informed Consent.

1. Nature of Telehealth Services

Telehealth involves the delivery of healthcare services using electronic communication technologies. SwiftCareMD provides asynchronous telehealth — this means you and your physician do not communicate in real time. Instead:

  • You complete a detailed intake questionnaire describing your symptoms, medical history, and the reason for your medical absence request
  • A U.S.-licensed physician reviews your submission and evaluates your condition based on the information you provide
  • The physician renders a clinical judgment and, if medically appropriate, issues a medical absence note
  • Your note is delivered to you electronically, typically within 1–2 hours

There is no live video, audio, or chat interaction between you and the physician. All communication is conducted through the information you submit on our platform and the documentation the physician provides in response.

2. Potential Benefits

Telehealth services through SwiftCareMD may provide the following benefits:

  • Convenience: Access medical absence documentation from home without scheduling an in-person appointment or waiting in a clinic
  • Speed: Receive your medical note within hours, not days
  • Accessibility: Available for patients in our licensed states who may not have easy access to a physician's office
  • Cost savings: A flat fee of $34.99 — typically less than an urgent care copay or out-of-pocket visit
  • Privacy: Consultation conducted from the privacy of your own location

3. Potential Risks and Limitations

As with any form of healthcare delivery, telehealth services have certain risks and limitations:

  • Limited examination: The physician cannot perform a physical examination. The evaluation is based solely on the information you provide
  • Reliance on self-reported information: The accuracy of the physician's assessment depends on the completeness and truthfulness of your responses. Inaccurate or incomplete information may lead to an inappropriate clinical decision
  • No prescriptions or diagnostic tests: SwiftCareMD does not prescribe medications, order laboratory tests, or provide imaging. Our services are limited to evaluation for medical absence documentation
  • Technology risks: Electronic communication may be subject to technical failures, interruptions, or unauthorized access, despite our security measures
  • Not a substitute for in-person care: Telehealth does not replace the need for in-person medical care when a physical examination or diagnostic testing is medically necessary
  • Physician may decline: If the physician determines that your reported symptoms do not support a medical absence, your request may be declined

4. Your Rights During Telehealth

As a telehealth patient, you have the right to:

  • Withhold or withdraw consent for telehealth services at any time before your consultation is reviewed by a physician
  • Know the identity, licensure, and qualifications of the physician evaluating your request
  • Access your medical records generated through our platform
  • Be informed of all potential risks, benefits, and alternatives to telehealth
  • Expect the same standard of care as you would receive in an in-person encounter for the same type of service
  • File a complaint if you believe your rights have been violated (see our HIPAA Notice )
  • Have your PHI protected in accordance with HIPAA and applicable state law

5. Technical Requirements

To use SwiftCareMD's telehealth services, you need:

  • A device with internet access (computer, smartphone, or tablet)
  • A modern web browser (Chrome, Safari, Firefox, or Edge — current version recommended)
  • A valid email address for account creation and note delivery
  • A stable internet connection sufficient to complete the intake form

Since our services are asynchronous and text-based, no webcam, microphone, or special software is required.

6. Emergency Situations

SwiftCareMD is NOT appropriate for medical emergencies.

If you are experiencing a medical emergency — including chest pain, difficulty breathing, severe bleeding, loss of consciousness, signs of stroke, or suicidal thoughts — call 911 or go to your nearest emergency room immediately.

Our Services are intended for non-emergency, minor acute conditions such as cold and flu symptoms, mild gastrointestinal issues, minor aches and pains, mild allergic reactions, fatigue, and similar conditions that may require temporary absence from work or school.

You agree that you will not use SwiftCareMD as a substitute for emergency medical care and that you will seek immediate in-person medical attention if your condition worsens or you develop new, concerning symptoms.

7. Consent to Treatment

By submitting a consultation request through SwiftCareMD, you consent to the following:

  • You consent to an asynchronous telehealth evaluation of your reported symptoms by a licensed physician
  • You understand that the physician's evaluation is based on the information you provide and that a physical examination will not be performed
  • You understand that the physician may, in their clinical judgment, approve or decline your request for medical absence documentation
  • You consent to the creation, storage, and transmission of medical records related to your consultation
  • You authorize SwiftCareMD to deliver your medical absence note electronically to the email address you provide
  • You consent to the physician contacting you via email if additional information is needed to evaluate your request

8. Record Keeping

SwiftCareMD maintains medical records of all consultations in accordance with applicable federal and state laws:

  • Your consultation records include your intake responses, the physician's assessment, and any documentation generated
  • Records are stored in HIPAA-compliant, encrypted systems
  • Records are retained for a minimum of 7 years from the date of service, or longer if required by state law
  • You may request access to your records at any time (see our Privacy Policy )

9. State-Specific Information

SwiftCareMD is licensed to provide telehealth services in the following states. Additional state-specific requirements and patient rights are noted below:

Florida (FL)

In accordance with Florida Statutes §456.47, telehealth services are provided by physicians licensed in the State of Florida. The physician-patient relationship is established upon acceptance of your consultation. Florida law requires that the standard of care for telehealth be the same as for in-person services. You have the right to request an in-person visit instead of telehealth at any time.

Arizona (AZ)

Under Arizona Revised Statutes §36-3602, telehealth services may be provided asynchronously by licensed physicians. Arizona law permits the establishment of a physician-patient relationship through telehealth. Informed consent for telehealth must be obtained before services are provided. You retain all rights afforded under Arizona patient privacy laws.

Utah (UT)

In accordance with Utah Code §26-60-102, telehealth services are recognized as a legitimate mode of healthcare delivery. The physician must use professional judgment consistent with the prevailing standard of care when providing telehealth services. An in-person follow-up may be recommended if the physician determines it is necessary.

Virginia (VA)

Under the Code of Virginia §38.2-3418.16, telehealth is defined as the use of technology to deliver health care services. Virginia permits asynchronous telehealth with appropriate informed consent. You must be physically located in Virginia at the time of your consultation. The treating physician must be licensed in Virginia.

Indiana (IN)

Under Indiana Code §25-1-9.5, telehealth services are permitted when a proper physician-patient relationship is established. Indiana requires that the standard of care for telehealth be consistent with in-person services. Physicians providing telehealth must be licensed in Indiana and must maintain appropriate medical records. You have the right to request an in-person consultation as an alternative.
